The 5 things every NCS contract needs — and the one most are missing

A quick audit of the clauses that separate a professional NCS contract from a Canva template, plus the one protection most specialists leave out.

Most NCS contracts are one of two things: a Canva template downloaded from Etsy for twenty dollars, or a PDF a senior NCS shared years ago that's been passed around Facebook groups ever since. Both are better than no contract. Neither is what you want on night four when a family is trying to push a schedule change you never agreed to.

Here are the five clauses every NCS contract needs, followed by the one most specialists leave out — the one that costs you the most when it matters.

1. Scope of care

Exactly what you do and don't do. Overnight infant care. Feeding, diapering, soothing, sleep shaping, documenting in the shift log, producing a morning report. Be specific about what's out of scope: cooking for the family, overnight care of older siblings, dog walking, laundry that isn't the baby's. If a family asks "would you mind putting a load in," you want to be able to point to the contract, not carry the uncomfortable conversation alone.

2. Schedule and hours

Agreed shift start and end times. What happens if the family is late home. What happens if they want you to stay longer on a given night — is that automatic overtime, or a separate negotiation? Is there a minimum shift length? Recurring pattern (four nights on, three off) spelled out explicitly.

3. Rate, retainer, and payment terms

Hourly rate. Any premium for multiples, holidays, or short-notice shifts. Retainer amount (most senior NCS take 25–50% up front, applied against final invoices). Payment schedule — weekly, bi-weekly, or end-of-contract. Preferred payment method. Late payment policy.

4. Cancellation policy

The single most emotionally charged clause in any NCS contract, because babies arrive when they arrive. Spell out: how much notice is required before the start date, how much of the retainer is refundable at what distance from the start, what happens if the baby arrives early or late, what happens if the family cancels mid-contract, what happens if you have to cancel due to illness.

Specificity protects the relationship. Vagueness turns a sad cancellation into a disagreement.

5. Illness and backup

What happens if you get sick. Do you arrange backup coverage through a peer NCS? Does the family pay your backup at your rate or hers? What if you're exposed to illness at another client's home — when do you pause that family's shifts? What if someone in the family's home is sick when you arrive?

Covid-era contracts forced every NCS to tighten this clause. Keep it tight.


The one most contracts are missing: confidentiality and image rights

The overwhelming majority of contracts we see say nothing about photos, videos, or what the NCS can share about the family online. This is the clause families increasingly want, and the clause most specialists are least prepared for.

What should it cover:

  • Whether you can take photos of the baby at all (with or without face showing)
  • Whether those photos can appear on your booking page, Instagram, or testimonials
  • What happens if a family shares your morning report publicly — do they have a license to do that?
  • What you do with the family's information after the contract ends

A good image-and-confidentiality clause does two things at once: it protects the family's privacy, and it protects your right to build a professional portfolio. Most templates do neither. Most disputes we hear about trace back to an un-had conversation about one of these points.
